CARES Act Update Regarding Notices to Pay or Quit
(May 5, 2023) The CARES Act has been interpreted to require a 30-Day Notice to Pay in addition to 30 days to quit by a Washington State Court. Until a California court rules, calculation of the notice period is subject to differing opinions. The California Apartment Association (CAA) believes that the CARES Act requires 30 court days for the tenant to pay, instead of the lesser 30 calendar days, which I believe is required by the CARES Act. As explained below, I recommend using a NEW 30-Day Notice to Pay or Quit. This memorandum addresses Properties subject to the Coronavirus Aid, Relief, and Economic Security Act, commonly known as the CARES Act. These are residential rental properties that are financed by federally backed loans, or that participate in federal affordable housing programs. There is a NEW perspective on required Notices to Pay or Quit, which may differ from what you already understand.

Biden-Harris Administration Announces New Actions to Protect Renters and Promote Rental Affordability
(Jan 25, 2023) Today, the Biden-Harris Administration is announcing new actions to increase fairness in the rental market and further principles of fair housing. These actions align with a new Blueprint for a Renter’s Bill of Rights that the Administration is also releasing today. The Blueprint lays out a set of principles to drive action by the federal government, state, and local partners, and the private sector to strengthen tenant protections and encourage rental affordability.
These new announcements are part of a broader set of federal actions that exemplify the principles laid out in the Blueprint for a Renter’s Bill of Rights, which underscores key protections every renter deserves including:
- Safe, Quality, Accessible, and Affordable Housing
- Clear and Fair Leases
- Education, Enforcement, and Enhancement of Renter Rights
- The Right to Organize
- Eviction Prevention, Diversion, and Relief
The Administration has been making progress in advancing a long-term goal of providing housing vouchers to all eligible households: the 2022 and 2023 President’s Budgets proposed to expand rental assistance to an additional 200,000 households – and the Administration has secured rental assistance to more than 100,000 households through the 2022 and 2033 appropriations bills and the American Rescue Plan. And last week, HUD published a Notice of Proposed Rulemaking on its efforts to Affirmatively Further Fair Housing.
